Kolkata: The State Department of Transport has clarified to Kolkata Traffic Police that the new enforcement cab guidelines introduced by the state will not apply to bicycles. In the same breath, the cops clarified that the police can continue their pursuit of the bikes, if they do not have yellow commercial license plates. The announcement came after police asked for clarification on the legal status of the enforcement bikes.
There are less than 60 licensed bicycle taxis with yellow license plates in the city. However, more than 95% of bike taxis are deemed illegal by cops, who stop and fine riders. This led to bikers staging protests and blocking roads, putting both the transport department and enforcement agencies in trouble. Several enforcement service unions have met with the Minister of Transport, seeking his intervention.
“Under the Motor Vehicle Act of 1988, states may issue licenses for taxis under sections 72 and 73. Therefore, it is legal for states to issue taxi licenses to all types of vehicles, including two-wheelers,” a transportation department said. official.
However, Section 53(1) (b) of the Act states that private vehicles may have their registration suspended if they are used for “hire or remuneration without a valid licence”.
A prominent bike taxi app operator says the service cannot be deemed illegal due to the lack of a specific legal prohibition in motor vehicle law against owners of private bikes sharing their passenger seat. with customers.
